In 2015\u00a0stonden er\u00a0nog circa 33.000 kinderen onder toezicht, en in 2017 zijn dit er (voorlopig) nog 29.000.\u00a0Bij een ondertoezichtstelling wordt er een gezinsvoogd voor het kind aangewezen, die de ouders kan adviseren over de opvoeding. Een <em>ondertoezichtstelling<\/em> wordt altijd uitgesproken door een rechter en in bijna alle gevallen wordt dit verzocht door <em>de Raad voor de Kinderbescherming<\/em>. Ook het Openbaar Ministerie kan een verzoek doen om een kind onder toezicht te stellen. De rechter kan een ondertoezichtstelling voor maximaal \u00e9\u00e9n jaar uitspreken. Na verloop van een jaar kan er dan een verleningsverzoek ingediend worden, waarna de rechter de ondertoezichtstelling weer met \u00e9\u00e9n jaar kan verlengen.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-447 alignleft\" src=\"http:\/\/www.sievaladvocaten.nl\/wp-content\/uploads\/2018\/10\/Ondertoezichtstelling-300x200.jpg\" alt=\"\" width=\"342\" height=\"228\" srcset=\"https:\/\/sievaladvocaten.nl\/old\/wp-content\/uploads\/2018\/10\/Ondertoezichtstelling-300x200.jpg 300w, https:\/\/sievaladvocaten.nl\/old\/wp-content\/uploads\/2018\/10\/Ondertoezichtstelling-768x511.jpg 768w, https:\/\/sievaladvocaten.nl\/old\/wp-content\/uploads\/2018\/10\/Ondertoezichtstelling.jpg 1000w\" sizes=\"auto, (max-width: 342px) 100vw, 342px\" \/><\/p>\n<h4>Wanneer wordt een ondertoezichtstelling uitgesproken door de rechter?<\/h4>\n<p>Allereerst dient er sprake te zijn van een dusdanige\u00a0situatie dat de ontwikkeling van het kind ernstig wordt bedreigd. Wanneer hier sprake van is, is lastig te bepalen. Elke situatie is anders, en daarom hangt het af van de feiten en omstandigheden van het geval. Uiteindelijk is aan het aan de kinderrechter\u00a0om te bepalen of een ondertoezichtstelling nodig is. In sommige gevallen kan bijvoorbeeld een ondertoezichtstelling worden uitgesproken met enkel als doel om een omgangsregeling vast te stellen. De rechter onderzoekt bij een ondertoezichtstelling ook of de ondertoezichtstelling nog kan worden voorkomen door (vrijwillige) hulpverlening in te zetten.<\/p>\n<h4><\/h4>\n<h4>Zelf een ondertoezichtstelling vragen?<\/h4>\n<p>Hoewel het niet vaak voorkomt, kan een ouder in sommige gevallen ook zelf een ondertoezichtstelling vragen.
